Experience

Jennifer Rappoport Colimon is a commercial litigator with a primary focus on employment disputes. Licensed in both Texas and California, Jennifer litigates high-stakes cases—class actions and collective actions involving the Fair Labor Standards Act and the California Labor Code, including the California Private Attorneys General Act (PAGA), as well as disputes over trade secrets, restrictive covenants, wrongful termination, employment discrimination, harassment, and breach of contract. Jennifer frequently conducts sensitive investigations into allegations of misconduct. Due to her extensive experience in California, Jennifer provides valuable counsel to Texas businesses with operations in California, including advising companies on the complexities of California law.

Jennifer takes a big-picture view of her clients’ needs, with an eye toward how all the pieces fit together. She provides practical, actionable advice and is a go-to resource when her clients need counsel on complex questions. Jennifer’s clients appreciate her ability to communicate complex legal concepts clearly. She understands how a business must weigh risk in all legal decision-making and can help assess and measure risks against the benefit to the business. Jennifer can also seamlessly step in as outside General Counsel to large and small companies.

In 2022, Jennifer served as interim General Counsel of SunPower Corporation, a publicly traded, leading solar technology and energy services provider in North America. From 2014 to 2020, she managed SunPower’s global commercial litigation docket and was employment counsel. This significant in-house experience gives her real insight into her clients’ perspectives and a unique ability to help meet their business objectives through legal strategies.

Before SunPower, Jennifer spent twelve years as an employment litigator at Winston & Strawn. Jennifer joined Botkin Chiarello Calaf as one of its founding partners in 2023, after litigating for three years at Wittliff Cutter PLLC where she also served as Managing Partner.

A native Californian living in Austin, Jennifer is still deeply tied to her UCLA Bruins as the President of the UCLA Austin Alumni network, and to her law school as a Trustee on the UC Law SF Board of Trustees.

Representative Cases

Litigation

  • Obtained a voluntary dismissal of all class claims in a California wage and hour class action/PAGA lawsuit, resulting in nominal settlement of individual claims;
  • Obtained a voluntary dismissal of collective action claims in a Fair Labor Standards Act (FLSA) case in Texas, and nuisance settlement value of the individual plaintiff claims;
  • Negotiated favorable settlement of three overlapping California wage and hour/PAGA cases involving over 2,500 class members;
  • Secured a preliminary injunction enforcing non-solicitation obligations of a former branch manager of a mortgage loan company;
  • Represented a diagnostic laboratory medicine company in a wrongful termination lawsuit by a former executive;
  • Defeated certification of nationwide FLSA collective actions;
  • Obtained complete dismissal of consumer lawsuit alleging Telephone Consumer Protection Act and Texas Deceptive Trade Practices claims.

Counseling

  • Provides advice on high-risk situations, including sensitive termination and discipline issues, potential harassment claims, and tricky compensation matters;
  • Oversees and conducts investigations into various workplace matters, including workplace fatalities, allegations of sexual harassment and discrimination, and improper conduct;
  • Regularly helps businesses navigate multistate reductions in force;
  • Prepares Position Statements in response to Charges of Discrimination.

General Counsel/In-House Experience

  • Served as interim general counsel for public company;
  • Managed corporate national and international commercial litigation docket;
  • Advised on employment aspects of multiple international M&A transactions.
